Can BCS collect on older accounts?

BCS can generally collect on accounts that are up to six years old. Legal action can be pursued within two years of delinquency. The older the file, the less likely that funds will be recovered.

What are the chances of my account being collected?

Every account is unique. Recovery potential is determined by how old the account is, how much information you obtained when extending credit, whether the business is still operating or the debtor is solvent, how recently your account information was updated or valid, whether the account is in dispute, and how often the debtor has refused to pay. As references will attest, BCS recovers a high proportion of accounts assigned.

How long will it take to collect the account?

Accounts can be collected in as little as one phone call, or may take time to resolve. We persist in collecting the account, and you don’t pay until we recover funds for you.

I have a legal judgment; can I send the account to collection?

Yes, when you send the account in be sure to send a copy of the original judgment, a completed listing sheet, any writ of enforcement and any cancelled or NSF cheques from the debtor.

Does your agency pursue legal actions?

Yes, we regularly pursue legal actions in both Small Claims Court and Court of Queens’ Bench. Legal action is only pursued if signed off by the client. We will not pursue legal action unless a thorough credit assessment deems that there is potential for eventual collection of the account. Accounts need to be sued within two years of delinquency, in most jurisdictions. An upper limit of $25,000 for Small Claims action is in place in Alberta; lower in some other jurisdictions. Once a judgment is obtained, we can pursue other actions to collect on the account.

Does BCS list on the Credit Bureau?

Yes, at the clients’ discretion we list both consumer and commercial accounts on both major credit bureaus. (Equifax and Transunion) We recommend listing accounts to prompt payment; there is no cost to the client for the service. The listing remains on a debtor bureau for seven years plus one day.

When should I place an account for collection?

Place an account for collection if debtors have missed deadlines, broken promises, or displayed non-responsive / avoidant behaviour.

What if a debtor refuses to pay within a reasonable time frame?

BCS may recommend formal litigation. At that time you decide whether you wish to proceed with litigation through BCS’s legal department. BCS will not initiate any legal action without prior authorization from the client.

How will I know how my claim is progressing?

Any collection activity is recorded on our Collect Software system. Feel free to contact our office anytime for an immediate update. BCS will also contact you regarding significant developments on your account and can update you with regular status reports on files, per your request. Files are called immediately upon receipt and scheduled for follow-up during the 7 am to 7 pm period allowed in most jurisdictions, always adhering to provincial regulations. All collection calls are queued to collectors’ daily call lists in priority sequence. No call back may be scheduled beyond the maximum allowable date and BCS collectors’ workloads are carefully managed to ensure they have the time, resources and support required to give each and every client the best service possible.

What other sources of money are available to help me clear up this debt?

Many people in similar situations have received help from family or friends; others access RRSP’s and GIC’s, retirement savings, or obtain advances from employers. Others negotiate payments from financial institutions or secure a consolidation loan. There is usually an option available that is better for you than not resolving this account.
